The ERC emphasizes that the amendment of the statutes is a matter of constitutional legislative reserve, and the State's resolution does not appear to be a sufficient instrument for this regulation. The Advisory Board, announced as a mitigation mechanism, had its implementation deferred until the election of the next board of directors (2030-2033), leaving Lus unprotected during the current term (2026-2029). The three executive administrators were also appointed the day before the prior opinion requirement of the Advisory Board came into force.
In addition to the complaint to the ERC, the Journalists' Union also submitted a claim to the Ombudsman against the Government, arguing that the new statutes undermine constitutional principles of freedom of information.
