São Paulo Court Suspends Dismissal of Delegate Da Cunha, Federal Deputy Who Faked Kidnapping Video

The São Paulo Court granted on Thursday (3) an injunction suspending the dismissal of delegate and federal deputy Carlos Alberto da Cunha, known as Delegate Da Cunha, ordered by Governor Tarcísio de Freitas. The single-judge decision was made by Desembargador Álvaro Torres Júnior and is provisional, and will still be evaluated by the Special Chamber of the court.

Delegate Da Cunha has been a member of the São Paulo Civil Police for 23 years and had been subject to a disciplinary process at the Internal Affairs department since 2020. He was dismissed under the accusation of having faked the recording of a video with an alleged kidnapping victim, with the goal of gaining followers on social media.

According to the Desembargador, there was a risk that the dismissal would be carried out before a more thorough analysis of the case. The parliamentarian's defense questioned the regularity of the administrative procedure that resulted in the dismissal, arguing that evidence was added to the case after the investigation phase was closed. An appeal against the decision is still possible.
