Anacom applied a fine of 350 thousand euros to Nos for a unilateral modification of contractual conditions that involved 821,641 subscribers. The operator introduced mandatory viewing of advertising in the automatic recordings functionality of the TV Service, without communicating in writing, in an adequate manner and with a minimum advance notice of 30 days, the proposal for alteration and the right of customers to terminate the contract without any charge.
As happened with Meo and Vodafone, which had been fined in April, Nos was sanctioned for the same practice. The fine, whose decision is from July 7, has already been contested by the operator.
The platform in question is Playce, an addressable advertising platform made available by the three operators, which was suspended on May 1 of the last year following a note of illegality from the Competition Authority. In June, the AdC applied fines of 13.35 million euros to Meo, Nos, Vodafone and Accenture for anti-competitive agreement in subscription television services and in advertising on television recordings.
The Competition Authority explained that the agreement led to a concerted approach by the three largest telecommunications operators, together with a consulting company, determining that customers were left without effective possibility of changing operators in the face of simultaneous and concerted degradation of the service. Nos, Vodafone and Accenture contested the decision, while Meo proceeded with voluntary payment of the fine.
