Minister André Mendonça, of the Supreme Federal Court, positioned himself alongside Court President Edson Fachin in a procedural question presented by colleagues Gilmar Mendes and Dino. The disagreement occurred during the session involving the case of Alexandre de Moraes and messages exchanged with businessman Daniel Vorcaro.
Gilmar Mendes and Dino criticized the fact that Fachin had assumed the rapporteurship of the case and had "assumed" the jurisdiction for himself. The ministers questioned the handling of the process by the court president.
Fachin, in turn, defended himself stating that the case was sent to him as rapporteur, and not assumed on his own initiative. The minister explained that, based on the findings that were forwarded to him, he identified that the court's own prerogative was at stake.
The president of the STF recalled that the court has understood in recent years that not necessarily any illegal practice that affects the court falls under the president's jurisdiction, thus justifying his decision to handle the case as rapporteur.
