Minister Flávio Dino, of the Supreme Federal Court (STF), sent an official communication to the Court's decano, Gilmar Mendes, pointing out irregularities in the conduct of proceedings related to the Master case by the court's president, Edson Fachin. In the document, Dino asks for the adoption of measures to reestablish compliance with the Constitution, the law, and the Internal Rules.
Dino argues that Fachin promoted a kind of "avocation" of proceedings that were under the rapporteurship of other ministers, without constitutional, legal, or regimental provision. The minister defends that cases involving ministers cited in the investigations be analyzed together on the next 23rd.
According to Dino, the first irregular situation occurred on the 9th, when Fachin suspended a decision issued by Dino himself. Then, on the 12th, the president of the STF ordered the transfer to the Presidency of proceedings that were under the rapporteurship of André Mendonça and assumed the rapporteurship of another procedure related to the Master case.
