Fachin stated that he did not "assume" the case files, but that the documents were forwarded to the presidency and he became aware of the report.
Ministers Gilmar Mendes and Flávio Dino questioned Fachin's decision to assume the rapporteurship of the case, removing the rapporteurship from minister André Mendonça. Fachin became the rapporteur by his own decision following this removal.
Gilmar Mendes clarified that he suggested to Fachin that he "attract" PET 16.662 to the presidency only for the purpose of delimiting the object of the judgment, and not to permanently assume the rapporteurship. The minister stated that he "at no point contemplated" the president of the Court assuming the rapporteurship of the procedure.
The issue also involves the internal rules of the Supreme Court, which determine the rules for distribution of cases, a point that was mentioned in the context of the dispute over who should conduct the case.
