Minister Gilmar Mendes questioned on Tuesday the decision of the president of the Supreme Federal Court, Edson Fachin, to take over the rapporteurship of the case involving messages from banker Daniel Vorcaro to Minister Alexandre de Moraes. Gilmar challenged Fachin's attitude, who removed Minister André Mendonça from the case's rapporteurship and began conducting the proceedings.
Gilmar clarified that he only suggested to Fachin the attraction of PET 16.662 to the presidency for the purpose of delimiting the object of the judgment, not to assume the rapporteurship definitively. The minister stated that at no point did he consider that the court's president would assume the proceedings, and recalled that the internal rules of the STF determine the distribution of cases with exhaustive exceptions for the president.
The case involves messages exchanged between Vorcaro and Moraes, whose content was revealed during the investigations of Operation Car Wash. The transfer of the rapporteurship to Fachin generated controversy within the court, reigniting debates about independence and the distribution of cases at the court.
Subsequently, Minister Flavio Dino agreed with Gilmar Mendes' position. The two magistrates are known to be close to Moraes within the court, which makes the episode even more significant for the internal scenario of the STF.
