'Dark Horse': producer in the US says he will not hand over documents to Federal Police without a US court order, email shows

An email obtained by the Federal Police investigation into the financing of the film Dark Horse reveals that a North American producer instructed that the company's documents not be handed over directly to Brazilian authorities. Michael Davis, who identifies as the majority partner of Go Up Entertainment LLC, sent the message to producer Karina Ferreira da Gama on September 2, after she received a Federal Police summons requesting information for the investigation.

In the email, Davis states that, on the advice of his lawyers in the United States, corporate, accounting, tax, banking, or contractual documents from Go Up should not be sent directly to Brazilian authorities. According to him, any requests should be made through diplomatic and international legal cooperation channels, such as a letter rogatory or mutual legal assistance request.

The instruction was given after Karina received a Federal Police summons requesting information about the film's financing. The producer claimed that any delivery of documents should only occur through a US court order, following the legal procedures for cooperation between the two countries.
