A worker in Spain was disciplinarily dismissed for using artificial intelligence without the company's authorization, performing work for other companies during working hours and failing to meet deadlines due to lack of motivation. The case ended up reaching the Superior Court of Justice of Castile and León, which confirmed the dismissal.
The court considered that the use of AI tools without authorization violated the company's internal rules and compromised the organization's data security. Furthermore, the worker carried out activities for other companies, which constituted a conflict of interest and a violation of the duties of exclusive dedication.
The failure to meet work deadlines was also mentioned as a reason for the dismissal, with the court emphasizing that the worker's justification that "he didn't feel like it" did not constitute a valid reason for failing to meet his professional obligations.
The ruling of the Superior Court of Justice of Castile and León fully confirmed the disciplinary dismissal, considering that the conditions were met for the termination of the employment contract due to reasons attributable to the worker.
