A decision from the Justice of Goiás suspended two auctions of rural properties less than 48 hours before their scheduled date. The action was conducted by the law firm Moraes, Prado & Paes Leme Advogados (MPPL), which represented a rural producer from Santa Rosa de Goiás. The properties were to be auctioned on August 27 and 28.
The Civil Court of the Municipality of Petrolina de Goiás analyzed the arguments and documents presented by the firm and identified, on a preliminary basis, elements that question the validity of the default used to justify the early maturity of the operation and, consequently, the auctions.
The dispute involves a credit operation contracted with Sicoob Unicentro Norte Brasileiro. In the action, MPPL demonstrated that the cooperative prematurely considered the debt, questioning the legitimacy of the process that led to the auctions.
The case raises a broader issue about the extent to which a financial institution can move forward on a property given as collateral when there are still doubts about the default that grounded the execution.
