The Nazaré Council deliberated again on the Municipal Regulation for the Sustainable Management of Local Accommodation in an extraordinary meeting, aiming to regularize a procedure that became legally uncertain after an opinion from the Commission for Coordination and Regional Development of Lisbon and Vale do Tejo (CCDR-LVT), which deemed the executive's previous decisions null.
The deliberations in question were taken on April 7 and June 16, in which five of the seven executive members declared themselves impeded from participating in the discussion and voting, as they had local accommodation businesses or direct family members linked to the activity. Only two elected members remained in the room and the document was approved with those two votes, which led CCDR-LVT to consider that the legal quorum of four members was not ensured.
The Council's legal services and two jurists consulted by the Municipality presented different interpretations regarding the application of the impediment rules and the existence of a lack of quorum. Despite the divergences, the municipality opted for a solution of prudence and legal certainty, re-approving the decisions without repeating the entire procedure. The Council again approved the submission of the project for public consultation and deliberated on the approval of the regulation proposal and its forwarding to the Municipal Assembly.
The Mayor, Serafim António, also declared himself impeded due to having a direct family member with local accommodation, and his impediment was approved unanimously. This time, the impeded elected members were replaced and six members of the executive participated in the meeting. The proposal was approved with five votes in favor and one against, from the Chega councilor, Lúcia Loureiro, who contested the legal solution chosen. Until the new regulation enters into force, local accommodation applications will continue to be assessed
