Minister Gilmar Mendes, decano of the STF, asked the court president, Edson Fachin, to postpone the trial scheduled for Tuesday (15th) and take over the rapporteurship of the case involving Minister Alexandre de Moraes and banker Daniel Vorcaro. Gilmar advocates for the consolidation of evidence elements and the two cases reported by André Mendonça, conducted by Fachin, so that the procedures are instructed and delimited before analysis by the plenary.
In the official letter sent to Fachin, Gilmar states there are doubts about the very nature of the process and says that the investigated party, the object of the investigation, the procedural rite, and the concrete issue that should be judged are still not defined. For the decano, the separate processing of procedures with common facts and evidence may generate irreconcilable decisions and procedural disorder.
Another minister of the Supreme Federal Court, Cristiano Zanin, also sent an official letter to the STF president claiming that the full data extracted from former banker Daniel Vorcaro's phone be shared with the parties.
