Technical review by ANS may increase costs for beneficiaries

The National Supplementary Health Agency (ANS) is studying the creation of a new readjustment mechanism for individual and family health plans, known as technical review. The topic returned to public debate after an internal agency draft gained repercussions in July 2026, which led ANS itself to comment on the matter.

Under the proposal under discussion, operators that prove financial imbalance in their individual health plan portfolios could apply the technical review in a diluted manner over three to five years. The proposed limit would be up to 20% per year, already considering the annual readjustment authorized by ANS.

Lawyer Elton Fernandes, a specialist in health plans, guest professor at the University of São Paulo and author of the Supplementary Health Law Manual, explained that the proposal, if approved, would not replace existing mechanisms. According to him, the technical review would be a new mechanism added to the current system.
