The Supreme Federal Court will decide next Tuesday (15) whether to open an investigation against Minister Alexandre de Moraes due to messages exchanged with banker Daniel Vorcaro. The extraordinary session was convened by the Court president as part of a set of measures to try to contain the internal crisis and regain control of the court.
The president of the STF, Edson Fachin, took several emergency decisions, including removing Moraes from the fake news inquiry rapporteurship, blocking the opposing decisions made by Ministers André Mendonça and Flávio Dino, and maintaining Andrei Rodrigues in command of the Federal Police.
On the 15th, the court will judge the validity of the Federal Police report on the case, in addition to the statement from the Attorney General's office, which considered the document null. With Luís Roberto Barroso's retirement still without a substitute, the court currently operates with ten ministers.
Legal scholars and law professors, such as Gustavo Sampaio from the Federal University of Fluminense, recommend that the magistrates directly involved in the crisis abstain from participating in decisions about the case.
