Sources close to Justice André Mendonça of the Supreme Federal Court (STF) consider that Justice Flávio Dino's decision to suspend the removal of the director-general of the Federal Police, Andrei Rodrigues, would have "overstepped" the acting of the Court's president, Edson Fachin. The assessment is that Fachin was already analyzing a request from the Attorney General's Office (AGU) to suspend Mendonça's decision.
Justice André Mendonça had ordered the preemptive removal of the PF director-general in light of suspicions of illegal monitoring and technical issues in intelligence reports. The AGU filed a request on Tuesday (8th) contesting Mendonça's monocratic decision.
The case was assigned to Edson Fachin, who ordered Mendonça to express his position on the matter. According to Constitutional Law experts consulted by the publication, the war of narratives requires a swift response from Fachin to clarify the situation.
Mendonça's decision to remove the PF director was pointed out by Dino as harmful to ongoing investigations. The case involves a dispute between different instances of the STF over who has the authority to decide on the maintenance or removal of the Federal Police director.
