Fachin under pressure and 'without tools': why the STF president cannot quell crisis on the eve of election

BBC News Brasil9 September 2026 at 08:54

The president of the Brazilian Supreme Court (STF), Edson Fachin, faces growing pressure to present quick responses to the crisis involving the Court, but experts consulted by BBC News Brasil point out that he has limited tools to act in the situation.

Fachin has not yet convened a plenary session to evaluate the conduct of the justices, which has intensified criticism of his management of the court in the weeks leading up to the elections.

The crisis occurs at a politically delicate moment, when the Court needs to demonstrate responsiveness without appearing to interfere in the electoral process.

According to experts, the institutional structure of the STF does not offer the president sufficient mechanisms to quell internal crises swiftly, leaving Fachin in a delicate position.
