São Paulo's Court recognized failures in the energy supply service provided by Enel during the blackout caused by the extratropical cyclone that hit the capital and the metropolitan region on December 9 and 10, 2025. Wind gusts reached 96 km/h, and more than two million homes were left without power. The decision, from the 31st Civil Court of the Central Forum, pointed out problems in crisis management, team mobilization, and electrical grid maintenance.
At the time, Enel blamed the strong winds for the blackout. The judge presiding over the case, Gisele Valle Monteiro da Rocha, rejected the utility company's argument that the weather phenomenon alone would be sufficient to eliminate its responsibility. For the magistrate, storms and cyclones are part of the foreseeable risks of electricity distribution activity, especially in a metropolitan region subject to severe weather events, as is the case with São Paulo.
