Criminal lawyer Fabio Tofic drafted a legal opinion holding that Justice Alexandre de Moraes of the Supreme Federal Court (STF) would have difficulty defending himself from the suspicions weighing on him in the context of the case involving Operation Compliance Zero. According to the jurist, this difficulty could lead to a broad annulment of the operation.

The Master Case, as it is also known, is at the center of a crisis among the STF's own ministers. Operation Compliance Zero investigates alleged irregularities in public contracts, and internal tensions at the court have called into question the continuity of the investigations.

For Tofic, the situation calls into question the impartiality of the trial, since Moraes acts simultaneously as investigator and judge in the case. The criminal lawyer argues that this duality of roles undermines the right to adversarial proceedings and full defense.

The possible annulment of the operation represents a significant blow to the investigations and reignites the debate about the independence of the Judiciary in Brazil. The case now awaits new procedural developments that may define the future of the inquiries.
