The PGR (Attorney General's Office) requested the annulment of the Federal Police report that indicated an alleged relationship between businessman José Carlos Vorcaro and Justice Alexandre de Moraes, of the Supreme Federal Court. The filing also includes a request to cancel all evidence obtained based on this report, as well as to terminate the related petitions.
According to the PGR, the investigation order against specific individuals was determined by Justice André Mendonça, of the STF, without any request from the Public Ministry and without any initiative from the Federal Police. The Attorney General's Office maintains that this determination exceeded the limits of judicial action in the pre-trial phase.
The PGR also points out that the investigation reached Justice Alexandre de Moraes without the necessary authorization to investigate a possible involvement of a Supreme Court justice. According to the Attorney General's Office's understanding, this type of investigation should have been submitted to the Court's Plenary.
In the PGR's assessment, André Mendonça should have referred the matter to the president of the STF, Justice Edson Fachin, so that the collegiate body could collectively assess the need to open an investigation against one of its members.
