The Superior Electoral Court (TSE) began on Tuesday the trial of an important case regarding the prohibition of the use of deepfakes in this year's elections. The discussion arises from an action filed by the PT against the display of a video produced with artificial intelligence that simulated a speech by former President Jair Bolsonaro during the PL convention.
The trial is considered a significant test for the application of rules on artificial intelligence during the electoral campaign. The case may establish parameters to define which content produced or manipulated with the technology should be classified as deepfake, a practice that is already prohibited by electoral rules.
Members of the court assess that, regardless of the outcome of the specific case, the trend is for the TSE to preserve as a general rule the prohibition on the use of deepfakes when the content presents a degree of realism capable of deceiving the voter.
The main division among the ministers is in the application of this rule, indicating that there are disagreements on how to implement the prohibition in practice in electoral processes.
