Supermarket convicted for forcing employee to work in 9x1 schedule

extra15 September 2026 at 11:00

A supermarket was convicted by the Ninth Labor Court of Manaus, of the Regional Labor Court of the 11th Region (AM/RR), for forcing an employee to work in a 9x1 schedule, in addition to maintaining precarious working conditions. The decision recognized the right to indirect termination of the professional's contract, determining the payment of labor rights, overtime, fines, and moral damages in the amount of R$ 10 thousand.

According to the case, the worker was hired in July 2021 to work in a 6x1 schedule. Between January and October 2025, he and other employees of the company were forced to work nine consecutive days to have only one day off, the so-called 9x1 schedule, which is considered abusive under labor legislation.

The company denied the accusations and challenged the documents presented by the worker. It claimed it did not adopt the 9x1 schedule, that it did not pay tips, and that the time records were valid. The defendant requested the rejection of all claims made by the employee.

The worker also requested moral damages, arguing that the working conditions to which he was subjected caused harm to his physical and psychological integrity. The judicial decision partially granted the requests, convicting the company to pay the determined amounts.

Why this matters

The decision serves as a precedent for thousands of workers facing abusive schedules in Amazonas, warning companies about the legal consequences of practices that violate labor rights and encouraging employees to seek labor justice when subjected to precarious conditions. WHY: The decision serves as a warning to employers in Amazonas about the legal consequences of abusive labor practices, while guiding workers suffering from irregular schedules to seek their rights in labor court.
