The acting governor Ricardo Couto sanctioned a law that grants an extra period of parental leave to servers of the state of Rio de Janeiro in case of birth of a child with a disability or rare disease. Law 11.314/2026, previously known as Bill 3.128/2017, was published in the Official Gazette this Monday and also creates parental leave for premature birth.
According to the new legislation, this additional period will be added to the regular parental leave, which is 120 days for the mother and five days for the father. The benefit will be granted with full salary and should begin by the day of the puerperium. When applicable, the leave may also be applied to paternity leave.
The law also establishes that, if the mother or the newborn remain hospitalized for more than two weeks, maternity leave will begin to count after the hospital discharge of whoever leaves the unit last. The extension of the benefit for the period corresponding to the time of hospitalization is also guaranteed.
