The two military police officers responsible for the murder of Dr. Andréa Marins Dias became defendants this Wednesday (09). Sergeant Major José Jorge Ferreira Dias and Second Sergeant Raphael Gomes Damasceno, both assigned to the 9th BPM, had the indictment accepted by the 2nd Criminal Court of the Capital. The doctor was shot dead on March 15 this year, in Cascadura, in Rio's North Zone, after her vehicle was confused with a suspect car.
The crime occurred during a search operation for vehicles suspected of involvement in robberies in the area. The police officers were chasing a silver Toyota Corolla Cross but lost sight of the car. Shortly after, they located a white Corolla Cross driven by Andréa, who was leaving her parents' house, and fired multiple times at the vehicle without confirming if it was the one they were looking for.
Andréa Marins Dias was hit by shots to the chest and abdomen and died at the scene. According to the indictment filed by the Public Ministry, the police officers acted with eventual dolus, meaning they assumed the risk of killing by firing even without being sure it was the suspect vehicle.
