The Supreme Federal Court (STF) decided to dismiss an action that questioned the use of private cars in practical lessons and in the driving test for obtaining the National Driver's License (CNH). With this, the Resolution of the National Traffic Council (Contran) remains valid, allowing candidates to drive their own vehicle during the practical test.
The action was presented by the National Federation of Cargo Transporters and Logistics (FNTTL), which contested the possibility of using private vehicles without adaptations or modifications in lessons and the exam. The entity argued that the measure would be incompatible with the Brazilian Traffic Code (CTB).
According to Minister Carmen Lúcia, rapporteur of the case at the STF, it would be necessary to verify if the resolution is in accordance with other existing laws. Still, the action was dismissed without an in-depth analysis of the merits of the question.
With the decision, candidates for the CNH continue to be able to use their own vehicles both in practical lessons and in the driving test, without the need for specific adaptations.
