Brake on colleagues, session about Vorcaro, fake news inquiry: understand all of Fachin's actions to contain crisis at STF

The president of the Supreme Federal Court (STF), Edson Fachin, took yesterday a series of decisions to try to circumvent the institutional impasse that has escalated in recent days at the court. Among the measures, the magistrate evoked for himself cases of great repercussion to manage the crisis.

In one of the actions, Fachin took over the investigation of the so-called fake news inquiry, removing Alexandre de Moraes from the case's rapporteurship. The president also scheduled for next Tuesday the trial of a Federal Police report that showed messages from banker Daniel Vorcaro to the minister.

On another front, Fachin suspended conflicting determinations by André Mendonça and Flávio Dino regarding the removal of the general delegate of the Federal Police, Andrei Rodrigues. The president kept the delegate in office, justifying that the removal would cause "serious harm to public order."

Fachin's decisions aimed to safeguard the integrity of the Court, seeking to contain the disputes among the STF's own ministers that intensified the institutional crisis at the court in recent days.

STF decides next week whether to investigate Minister Moraes over messages with Vorcaro

The Supreme Federal Court scheduled an extraordinary session for Tuesday (15) to decide whether to open an investigation against Minister Alexandre de Moraes due to messages exchanged with banker Daniel Vorcaro. The Court president took several measures to contain the internal crisis, including removing Moraes from the fake news inquiry rapporteurship, blocking opposing decisions by Ministers André Mendonça and Flávio Dino, and maintaining Andrei Rodrigues as head of the Federal Police. The court will analyze the validity of the PF report and the Attorney General's office statement, which considered the document null. With Barroso's retirement still without a replacement, the STF operates with ten ministers, and legal scholars recommend that the magistrates directly involved abstain from the judgment.
