Fachin reduces powers of Moraes and Mendonça, and will face biggest test of his management next week

The president of the Supreme Federal Court (STF), Edson Fachin, reduced the powers of ministers Alexandre de Moraes and André Mendonça by launching a package of decisions to ease internal tensions within the Court. Fachin removed Moraes from the rapporteurship of the Fake News inquiry and suspended Mendonça's decision to remove the director-general of the Federal Police, Andrei Rodrigues.

Additionally, Fachin decided that any and all procedures regarding a court member must be preliminarily referred to him. As a practical consequence, the measures weakened the actions of Moraes and Mendonça, who in recent days used decisions and PF reports to exchange accusations against each other.

The first accused the other of crimes of responsibility, abuse of authority, and administrative impropriety. The second requested the preparation of a PF report that suggested alleged practices of administrative advocacy and obstruction of justice.

The decisions also elevate Fachin's power at a time of internal conflict at the court, and the next week will bring a new test for his management, according to the publication.

STF decides next week whether to investigate Minister Moraes over messages with Vorcaro

The Supreme Federal Court scheduled an extraordinary session for Tuesday (15) to decide whether to open an investigation against Minister Alexandre de Moraes due to messages exchanged with banker Daniel Vorcaro. The Court president took several measures to contain the internal crisis, including removing Moraes from the fake news inquiry rapporteurship, blocking opposing decisions by Ministers André Mendonça and Flávio Dino, and maintaining Andrei Rodrigues as head of the Federal Police. The court will analyze the validity of the PF report and the Attorney General's office statement, which considered the document null. With Barroso's retirement still without a replacement, the STF operates with ten ministers, and legal scholars recommend that the magistrates directly involved abstain from the judgment.
