Amid crisis between ministers, STF resumes tax-related judgments

Amid the crisis between ministers André Mendonça and Alexandre de Moraes, the Supreme Federal Court (STF) tries to resume this Thursday the regular plenary agenda, with tax-related judgments that may affect companies and taxpayers. The sessions were scheduled for Wednesday, but were postponed after the president of the STF, Edson Fachin, cancelled the session amid the fallout from the decision that determined the return of Andrei Rodrigues to the position of director-general of the Federal Police (PF).

Among the scheduled topics are the incidence of PIS and Cofins on presumed ICMS credits and the collection of ITBI on the transfer of real estate for capitalization. The discussion about ITBI, resumed last Wednesday, centers on whether real estate purchase, sale, or rental companies should pay the tax when transferring assets and rights for incorporation into their share capital.

Minister Edson Fachin is the rapporteur of the ITBI action at the STF. The tax agenda may also include other pending processes, as the Plenary manages to advance with the sessions.
