The Advocacy-General of the Union (AGU) decided to maintain the appeal that requests the suspension of Minister André Mendonça's decision, which preventively removed the general director of the Federal Police, Andrei Rodrigues, even after Minister Flavio Dino reinstated the delegate to the command of the corporation. The AGU presented the request on Tuesday afternoon to the president of the STF, Edson Fachin.
The internal assessment of the AGU is that full legal certainty for Andrei Rodrigues to remain in the position will only be achieved with a pronouncement by Edson Fachin on the case, due to the antagonistic decisions between André Mendonça and Flavio Dino. Dino's dispatch, which attended to a request from Andrei himself, is the one in force at the moment because it is subsequent to Mendonça's decision.
Interlocutors of the attorney general of the union, Jorge Messias, consider that the arguments presented in the appeal are solid and that it is up to the AGU to maintain the defense of the Federal Police and the attributions of the Presidency of the Republic. The AGU argues that the measure taken by André Mendonça interferes with an attribution of the Presidency.
