The São Paulo court recognized Enel's failures in responding to the blackout caused by the extratropical cyclone that hit the capital and Metropolitan Region on December 9 and 10, 2025. The ruling by Judge Gisele Valle Monteiro da Rocha, of the 31st Civil Court of the Central Forum of the Capital, concluded that wind intensity was not sufficient to explain the delay in restoring service, indicating that other factors worsened the effects of the storm. Enel's report indicates that the blackout affected 4.4 million homes in Greater São Paulo.
The decision took into account an inspection conducted by the National Electric Energy Agency (Aneel) on the concessionaire's performance. The ruling identified problems in several areas, including failures in planning, team mobilization, network maintenance, and the available structure to deal with the emergency.
According to the decision, even with support from other distributors, reconstruction teams represented less than 5% of Enel's total workforce, showing an insufficient response given the magnitude of the problem. The court held the company responsible for deficiencies in crisis management, although it recognized that the weather event was responsible for the initial interruptions in power supply.
