Mendonça has legal authority to order removal of Andrei Rodrigues, lawyer affirms

The Second Chamber of the Supreme Federal Court formed a majority to uphold Justice André Mendonça's decision, which ordered the removal of the Federal Police Director-General, Andrei Rodrigues, from his duties. According to government sources to CBN, the Attorney General's Office (AGU) announced it will appeal on Tuesday against the justice's decision.

The AGU will argue that the removal violates the president's exclusive authority to appoint and dismiss holders of trust positions. The federal government considers that Mendonça's decision usurps an exclusive power of the Executive branch.

In an interview with CBN Brasil, constitutional lawyer Vera Chemim, a master's degree holder in Public Administration, defended the legality of Mendonça's decision. According to her, the removal falls within the justice's authority because he is the rapporteur of the investigation into the Master case, which is examining alleged irregularities.

Vera Chemim stated that, from the moment Andrei Rodrigues and the Attorney General, Paulo Gonet, were cited in the report that comprises the Master case investigation, and given the request submitted by the Novo Party, the justice gained legitimacy to order the removal, according to the facts presented in the article.
