The young woman Marta suffered a severe allergic reaction after drinking a smoothie that contained an ingredient she was allergic to. After consuming the drink, she went to the hospital to receive medical assistance.
At the hospital, a misdiagnosis of the young woman occurred, which ended up causing her serious brain injuries, leaving her in a coma. Marta's family considered that medical negligence was the direct cause of the sequelae suffered.
The family filed a lawsuit against the hospital institution and demanded 4 million euros in compensation for the damages caused. The court agreed that there was negligence and that the young woman should be compensated.
However, the court considered that the amount requested by the family was excessive, ultimately deciding to award 100 thousand euros in compensation to the young woman, a significantly lower amount than initially demanded.
