Minister Gilmar Mendes asked for a view and suspended the judgment of the Second Chamber of the Supreme Federal Court regarding the decision of Minister André Mendonça that determined the removal of the director-general of the Federal Police, Andrei Rodrigues. With the request for a view, the judgment was interrupted and there is no defined deadline for its resumption.
Mendonça had voted to maintain his own decision that removed Andrei Rodrigues from the command of the PF. The case is being analyzed by the Second Chamber, which is composed of ministers Luiz Fux (presiding), Gilmar Mendes, Dias Toffoli, Nunes Marques, and Mendonça himself.
Minister Mendonça stated that he was the target of systematic and illegal monitoring carried out by the intelligence area of the Federal Police for more than a month. According to him, six reports were produced between August 3 and 31 with analysis of his performance and his relationship with the attorney general, Jorge Messias.
The decision to remove Andrei Rodrigues was made based on a request from the Novo party. Mendonça argues that the analyzed material reveals the alleged irregularities in the monitoring, thus substantiating the removal of the director-general of the PF determined in his previous decision.
