The 1st Recursal Chamber of the Court of Justice of Santa Catarina maintained a sentence that condemned a municipal administration to indemnify a public servant in R$ 10 thousand for moral damages. The worker was left for about six months without exercising his functions, a situation which the Justice considered to characterize moral harassment and "forced idleness".
The server, who held the position of machine operator, lost his activities in June 2024, when the mayor designated another employee to operate a motor grader at the workshed. According to the records, this occurred after a disagreement about the reassignment of functions between the worker and the municipal administration.
Without receiving new assignments, the server would sit during the entire workday. He formally notified the municipality in July to know which functions he should perform, but there was no response. The situation persisted until the case reached the Judiciary.
