Judge José Luis Calama, instructor of the Zapata case, rejected on a ruling of September 4 the nullity incident presented by the former Government president's lawyer. The incident sought to challenge the previous decision of a magistrate to recuse herself from the case.
Judge Calama considered that the decision of the holder of Plaza number 15 of the Instruction Section of the Madrid Instance Court, María Esperanza Collazos, to recuse herself in favor of the National Court "complied with the legal rules of competence and distribution".
The ruling also states that this decision "did not produce any procedural deviation that could affect the fundamental right invoked". The case thus continues to be processed by Judge Calama at the National Court.
