The Superior Electoral Court approved, by majority vote, on Tuesday, parameters for the characterization of deepfakes in elections. The understanding of the president of the Court, Kassio Nunes Marques, should guide the analysis of other cases involving content produced or manipulated by artificial intelligence during the electoral campaign.
The discussion took place during the ruling on an action by the PT referring to a video produced with artificial intelligence that simulated a speech by former President Jair Bolsonaro during the PL convention that formalized the candidacy of Flávio Bolsonaro to the Senate.
The majority of the court followed Nunes Marques' vote and decided not to impose a fine for the display of the PL candidate's video. The prevailing understanding was that the piece did not constitute disinformation against opponents, but rather an artistic representation of the party's position.
