Minister Alexandre de Moraes, of the Supreme Federal Court (STF), used a Federal Police intelligence report as a basis to point out "strong indications" of crimes committed by fellow minister André Mendonça, his colleague on the Court. The corporation's document, however, presents a series of reservations about its own conclusions, including scenario analyses and information classified with "low" or "moderate" confidence levels.
One of the examples cited in Moraes's decision refers to an alleged attempt to bias investigations by Mendonça to target the Senate president, Davi Alcolumbre (União Brasil-AP). In his decision, Moraes considered this conduct an indication that his colleague acted irregularly. However, this information was labeled as a hypothesis by the analyst who produced the PF document, with a low confidence level.
The report also makes political insinuations about the Senate leadership and the STF composition, in addition to containing "intelligence" information described as "without probative value." The PF document is not an investigation report, but rather a scenario analysis on Mendonça's conduct, which raises questions about the appropriateness of its use as a basis for judicial decisions.
