STF condemns State of Piauí to compensate patient who became infertile after cesarean at MDER

Portal O Dia3 September 2026 at 11:50

The Supreme Federal Court condemned the State of Piauí to compensate a patient who became infertile after undergoing a cesarean at a public health facility. The Court rejected an appeal presented by the State Government and upheld the sentence previously issued by the Court of Justice of Piauí.

The case involves a patient who suffered complications during the surgical procedure, resulting in infertility. The compensation amount was set at R$ 25 thousand, to be paid to the patient for the damages caused.

The State had appealed the Court of Justice's decision seeking to reverse the conviction, but the STF confirmed the sentence and the payment obligation. The Supreme Court's decision represents the closure of the appellate instance at the federal level.

The conviction is based on the responsibility of the public authorities for damages caused to patients in procedures performed in the public health network, such as the cesarean performed at the mentioned facility.
