The 5th Panel of the Superior Court of Justice unanimously rejected the appeal that requested the return of Alexandre Nardoni and Anna Carolina Jatobá to closed regime. The trial was held in a virtual session, under the rapporteurship of Justice Ribeiro Dantas, and confirmed that the two continue serving their sentences in the open regime.
The appeal did not address a new investigation request regarding the murder case of Isabella Nardoni, which awaits a review of the authorship of the crime. The issue analyzed concerned the way the two were serving their sentences after progression to the open regime.
The request had been filed by the LGBTQIAPN+ Pride Association, which sought the regression of the sentence of the two convicted. However, the appeal was rejected by the five-member panel because the association did not pay the court costs required by the STJ, which prevented the case from proceeding in the court.
