Bill creating incentives for data center installation in Brazil approved

extra2 September 2026 at 11:02

The Senate approved on Tuesday the bill that establishes the incentive plan for the data center sector in Brazil. The text had already been approved by the Chamber of Deputies in February and was stalled among senators. The bill was unblocked after a meeting between President Luiz Inácio Lula da Silva and the Senate President, Davi Alcolumbre, last week.

The text now goes to presidential approval. Senator Cid Gomes was chosen to rapporteur the bill in the Senate and, to accelerate the implementation of the measure, maintained the merits of the Chamber's text, which was under the responsibility of Deputy Aguinaldo Ribeiro. Only drafting adjustments were made.

The bill establishes that data center companies must contract the entirety of their electricity demand through supply contracts or self-production from generation from renewable sources to be eligible for the tax benefits. Senators included the term "low emission" to allow cleaner thermal power plants to also supply energy to the sector.
