The Superior Electoral Court rejected the application of a fine to PL candidate for President, Bolsonaro, for the use of a video produced with artificial intelligence with the image of former President Jair Bolsonaro during the convention that formalized the candidacy. By four votes to three, the majority of ministers understood that there was no irregularity, since the content was displayed at a closed party event.
The court followed the vote of the president of the TSE, Nunes Marques, who considered that the internet transmission, with the use of deepfake, does not transform the convention into electoral propaganda directed at the electorate. According to Nunes Marques, political support manifestations made within a party convention are directed at party members and do not necessarily confuse with electoral propaganda.
The minister also highlighted that the legislation allows the disclosure of pre-candidacies and requests for political support, as long as there is no explicit vote request. The case was decided by a narrow majority, with three dissenting votes that understood that the use of deepfake technology should be punished with a fine.
