The prediction is that this will be the main debate if the court president, Justice Edson Fachin, brings the case to the Plenary.
The main argument of this group is that investigations of STF ministers must be authorized by the collegiate body in advance. Since there was no such prior consultation by the Federal Police, the assessment is that the information collected on Vorcaro's phone may be declared null, meaning without value to support any procedural acts.
The considerations are not related to the content of the messages identified by the Federal Police, but to the way they can now be used. The understanding of some justices, who said they were bewildered by the report, is that the case should have gone through the Plenary's review.
