The National Education Council (CNE) approved this Tuesday the regulation of artificial intelligence use in Brazilian schools and universities. The approval by the CNE plenary represented the final stage of regulation within the council. The text was reported by council members Celso Niskier and Israel Batista.
Among the main rules is the prohibition of students up to the 5th grade from using generative AI tools alone. The rules will take effect after approval by the Ministry of Education (MEC), and institutions will have 12 months to adapt to the new guidelines.
The regulation also prevents correction, evaluation, or grading by artificial intelligence of essay evaluations, essays, and authored works that require interpretive judgment. Additionally, any academic or disciplinary sanction based exclusively on automated AI-generated content detectors is prohibited.
Other practices prohibited by the resolution are: social scoring systems, automated recognition or inference of emotions of students and education professionals, and exploitation of user vulnerabilities.
