Pergaminhoflash contests tender for newspaper distribution and requests review of VASP data

Pergaminhoflash contested the preliminary report of an international public tender launched by the Government for the daily distribution of printed newspapers in low-density areas of Portugal. The report proposes excluding the company and awarding both lots of the tender to VASP, in a procedure valued at three million euros for the next three years, aimed at ensuring press distribution in 96 municipalities where the activity is less profitable or not profitable.

The company questions the pricing formation presented by competitor VASP, noting that the values correspond "to the cent" to discounts of exactly 30% and 20% on the base values of the two lots, despite the proposal indicating that they were determined from the actual cost structure. Pergaminhoflash considers that this coincidence reveals "manipulation in price formation" and asked the jury to analyze the issue. The company recalls that rulings by the Competition Authority and the Regulatory Authority for Media assign VASP a monopoly position in the market.

The distributor also contests the list of sales points indicated by VASP, since the specifications require five establishments in each covered municipality, operating at least 300 days per year. Pergaminhoflash claims that some locations presented cannot be considered true sales points and requests that the jury verify the identified establishments. The company also maintains that, without the proposed exclusion, the clause preventing the award of both lots to the same company would not apply.

The tender is provided for in the Action Plan for Social Communication and represents an annual support of one million euros for press distribution. When presenting the measure, the Minister of the Presidency, António Leitão Amaro, explained that the financing is intended for the least profitable routes, imposing a public service obligation on the winning company. The government official defended that "no one can be left without a newspaper" and that the goal is to ensure no territory is left in a "news desert."

Em causa está o concurso público internacional lançado pelo Governo para garantir a distribuição diária de jornais em papel nos territórios de baixa densidade, cujo relatório preliminar propõe excluir a Pergaminhoflash e atribuir os dois lotes à VASP.

A Pergaminhoflash decidiu exercer o direito de audição e pediu ao júri que verifique locais concretos apresentados pela concorrente como pontos de venda, além dos critérios usados para formar os preços da proposta.

O procedimento, avaliado em três milhões de euros para os próximos três anos, destina-se a assegurar a distribuição de imprensa em 96 municípios onde a atividade é menos rentável ou não lucrativa.

O concurso está dividido em dois lotes: um para as regiões Norte e Centro e outro para Lisboa e Vale do Tejo, Alentejo e Algarve.

Empresa questiona formação dos preços da VASP

O relatório preliminar, divulgado em 20 de agosto, propõe excluir a Pergaminhoflash e entregar a distribuição à VASP.

Num comunicado, a Pergaminhoflash recordou que deliberações da Autoridade da Concorrência e da Entidade Reguladora para a Comunicação Social atribuem à VASP uma posição de monopólio, resultante de uma quota de 100% no mercado.

A distribuidora sustenta que a diferença entre as duas propostas resulta sobretudo do preço, mas questiona a forma como os valores apresentados pela VASP foram calculados.

Segundo a Pergaminhoflash, os preços da concorrente correspondem, “ao cêntimo”, a descontos de exatamente 30% e 20% sobre os valores-base dos dois lotes, apesar de a proposta da VASP indicar que foram determinados a partir da estrutura real de custos da operação.

A empresa considera que esta coincidência revela “manipulação na formação do preço”, uma alegação que pede agora ao júri que analise.

Pontos de venda também são contestados

A Pergaminhoflash questiona ainda a lista de pontos de venda indicada pela VASP. O caderno de encargos exige a existência de cinco estabelecimentos em cada concelho de baixa densidade, devendo cada um funcionar pelo menos 300 dias por ano.

A empresa alega que alguns dos locais apresentados pela concorrente não podem ser considerados verdadeiros pontos de venda e solicita que o júri verifique os estabelecimentos identificados na proposta.

Com base nos critérios de adjudicação e nas correções que defende, a Pergaminhoflash estima que a VASP receberia uma pontuação inferior e que um dos lotes lhe deveria ser atribuído.

Relatório propõe entregar os dois lotes à VASP

A distribuidora chama também a atenção para a cláusula 13.ª do programa do concurso, segundo a qual cada concorrente só pode receber um lote.

A exceção que permite atribuir ambos os lotes à mesma empresa só se aplica, neste caso, devido à proposta de exclusão da Pergaminhoflash no lote correspondente a Lisboa e Vale do Tejo, Alentejo e Algarve.

“A exceção que permite entregar os dois à mesma empresa só se torna aplicável por efeito da exclusão proposta no Lote 2 da PergaminhoFlash, sublinhando-se que das atas do procedimento não consta verificação dos pontos de venda identificados na lista da concorrente VASP”, afirma a empresa.

Apoio pretende evitar “desertos noticiosos”

O concurso está previsto no Plano de Ação para a Comunicação Social e representa um apoio anual de um milhão de euros à distribuição da imprensa.

Quando apresentou a medida, o ministro da Presidência, António Leitão Amaro, explicou que o financiamento se destina às rotas menos rentáveis nos 96 municípios abrangidos, impondo uma obrigação de serviço público à empresa vencedora.

“O concurso público garante a chegada a todo o território. O apoio é desenhado para financiar as rotas para os 96 municípios onde ela seria menos rentável e seria mesmo não lucrativa e, por isso, há uma assunção de uma obrigação de serviço público a quem ficar e o Estado paga por esse serviço público”, afirmou.

O governante disse ainda que o objetivo era encontrar um operador com estabilidade e capacidade para distribuir jornais em todo o território.

“Ninguém pode ficar sem jornal, não pode haver nenhum território que fique em deserto noticioso e às escuras de informação livre”, defendeu António Leitão Amaro.

O modelo governamental inclui dois pilares: o financiamento direto da distribuição através deste concurso e um apoio ao funcionamento dos pontos de venda nos territórios de baixa densidade, em parceria com os municípios.

O valor do apoio foi calculado com base nos custos da atividade, nas diferenças territoriais e na evolução de despesas como os combustíveis e os salários.
