The Supreme Federal Court is analyzing in a plenary session a Federal Police report that points to a possible relationship between Justice Alexandre de Moraes and former banker Daniel Vorcaro, owner of Banco Master. Vorcaro is imprisoned for billion-dollar financial fraud. According to the report analyzed on Tuesday (15), Moraes exchanged 52 messages with Vorcaro.
The extraordinary session has ten justices present, two of whom declared conflicts of interest and are barred from voting: Dias Toffoli and Nunes Marques. With this, only eight justices can participate in the vote, which creates the possibility of a tie.
According to legal scholars consulted by CBN, in the event of a tie, STF President and Justice Edson Fachin would have a Minerva vote to decide whether to maintain or postpone the session. Other items on the agenda will be revisited when the proceedings resume.
The court's rules provide that this type of situation be resolved by the quality vote of the president, which in this case is Fachin. Dino also criticized Fachin for assuming the rapporteurship of cases that were with Mendonça.
