Supreme Federal Court justices assess that Court President Edson Fachin, by taking on the rapporteurship of the proceedings containing messages from former banker Daniel Vorcaro to Justice Alexandre de Moraes, sought to reduce tension at the start of Tuesday's session. With this measure, it fell to Fachin to make the first procedural proposal regarding the case involving Moraes, removing this responsibility from André Mendonça, who had been the previous rapporteur of the case.
Since the crisis at the Court began, with the disclosure of the messages, Mendonça and Moraes have been exchanging accusations through rulings and official letters. By assuming the rapporteurship, Fachin attempted to take Mendonça out of the spotlight of the case. Mendonça's conduct will also be analyzed in the Full Court next week.
Despite Fachin having assumed the rapporteurship, there are still doubts about the procedures that will be adopted. There is no clear provision in the STF's internal rules regarding the procedures to be followed, both regarding the case's processing and the stages of the trial.
