Decisions made by Supreme Federal Court ministers over the past few days regarding the contents of banker Daniel Vorcaro's cell phone have caused wear on Court President Edson Fachin in leading the unprecedented crisis installed in the tribunal with the developments of the Master case. Cristiano Zanin and Gilmar Mendes directly ordered the Federal Police to send the data from Vorcaro's cell phone, without consulting the court's presidency.
In both episodes, individual decisions occurred in parallel with procedures that were already under analysis by the presidency and anticipated solutions before a definitive statement from Fachin. Since Friday, Zanin had been requesting from Fachin that he guarantee ministers access to the raw material before the trial.
The backstage reading is that the episodes highlight an additional difficulty for Fachin. Beyond managing the dispute between André Mendonça and Alexandre de Moraes, the STF president needs to prevent his colleagues' individual moves from creating new facts and reducing his room to construct a way out of the crisis.
