Fachin denies joint session to judge Moraes and Mendonça cases at the STF

cbn12 September 2026 at 16:33

The president of the Supreme Federal Court (STF), Edson Fachin, denied on Saturday the holding of a joint session on Tuesday to judge the cases of ministers Alexandre de Moraes and André Mendonça. Fachin defined that Tuesday's session will be dedicated to judging the validity of the Federal Police report and the nullity request presented by the Attorney General's Office (PGR).

Moraes had requested that the analysis of the messages exchanged by him with businessman Daniel Vorcaro be conducted jointly with the investigations involving Mendonça in the handling of the Master case. The minister argued that the separate analysis of the proceedings generates contradiction with the recent position of the Court's Presidency.

The judgment of Mendonça's conduct in the Master case was rescheduled by Fachin for the following week, on September 23. In this way, the president confirms the judgment against the rapporteur of the Master case, who is precisely Mendonça.

In a ruling issued Friday night, Moraes criticized what he calls "selectivity" in the process. The minister states that Mendonça would have, in theory, committed conduct that will still be evaluated by the court, referring to the investigations into his role in the Master case.

Why this matters

Readers following the Brazilian legal-political scenario are directly affected by this decision, as the separation of judgments may influence the outcome of investigations about messages exchanged between Moraes and businessman Daniel Vorcaro and about Mendonça's handling of the Master case. Moraes's criticism of "selectivity" signals a possible internal conflict in the court that may impact the credibility and consistency of the Court's decisions.

Scrutiny Needed!

A new private Family Health Unit opened in Torres Vedras, concessioned by the State, serving 5,463 users without a family doctor, while 19 similar units are in the process of opening, five in the Algarve. The article questions the transfer of responsibilities from the NHS to private operators, suggesting that the Ministry of Health was unable or unwilling to hire available doctors. It also mentions rumors, denied by the Minister, about the handover of ULS Algarve to the Union of Misericórdias, and warns of a "profound reformulation" of the NHS without the necessary democratic scrutiny, recalling that PSD voted against the creation of the service in 1979 and that a 1982 decree-law on the NHS was declared unconstitutional by the Constitutional Court.
