The Supreme Court of Justice decided to block the expulsion of a cadet from the Public Security Police (PSP) who was the subject of disciplinary proceedings due to posts deemed homophobic and nationalist on social media. The court considered that the expulsion decision was not sufficiently justified.
The posts in question were made between December 2022 and April 2024, a period during which the cadet, identified as Henrique, was between 16 and 18 years old. The young man entered the PSP training course in October 2024, and was subsequently subjected to the disciplinary process that led to his expulsion.
The Public Prosecutor's Office had requested the dismissal of the case, but this position was contested by the PSP, which decided to proceed with the cadet's expulsion. The decision was then taken to the Supreme Court of Justice for review.
The court considered that the justification presented for the expulsion was insufficient, thus suspending the disciplinary measure. The case raises questions about the application of disciplinary sanctions to posts made before entering the police career, when the young man was a minor.
