The president of the Supreme Federal Court, Edson Fachin, made decisions this Wednesday that removed from Alexandre de Moraes the conduct of the Fake News Inquiry, generating a setback for the magistrate. However, allies of Moraes intend to use excerpts from Fachin's own decision to try to block an investigation against the judge in a plenary session scheduled for next Tuesday.
The process that will be analyzed by the plenary brings together a Federal Police report with information about alleged relationships of Moraes with banker Daniel Vorcaro. Fachin centralized in the presidency the different fronts opened during the crisis and determined the suspension of "any and all procedures" that involve a potential investigation against members of the STF.
The determination establishes that cases of this nature must be previously submitted to the presidency of the Court before proceeding. This creates an anterior stage to the opening or continuation of investigations involving ministers of the court.
Fachin's understanding coincides with one of the main arguments presented by the Attorney General's Office, which also defends restrictions on investigative procedures against members of the STF.
