The declassified documents by the Spanish Government on the migratory crisis in Ceuta at the end of July contain criticisms from the CNI, the Civil Guard and the National Immigration and Borders Center (CENIF) of the Police to the Supreme Court. These institutions criticized the ruling of July 8 that vetoed the hot returns of migrants who entered by sea.
The security forces considered that the judicial decision "contained the pressure" at the border and affected their response capacity. The Supreme Court considered that the rechazo en frontera (rejection at the border) is "an exceptional mechanism" that cannot be applied at sea.
The ruling responded to an appeal against the hot returns policy implemented after the massive entry of migrants in Ceuta. The court understood that, in the absence of border containment elements, immediate returns could not be carried out in maritime territory.
